General Terms and Conditions

The bicycle rental services are provided by the company Bike4U "B4U" (hereinafter referred to as the Rental Company) with its registered office in Lucerne, which is the owner of the rental bicycles. The General Rental Terms and Conditions form an integral part of the rental contract. By signing it, the Lessee confirms that he/she has read these Rental Terms and Conditions and accepts them unconditionally.

2. Contractual relationships
The contract is concluded between B4U and the customer. SBB AG, the licensed transport companies and other partners act as intermediaries for the services of B4U.

3. Takeover of bicycles
The Lessee takes over the bicycle in a safe and clean condition. Complaints on the part of the Lessee must be reported to the Lessor or agent when the bicycle is handed over. The Lessee must identify himself/herself with an official document (passport, identity card, driving licence).

4. Return of bicycles
The Lessee is obliged to return the vehicle to the Lessor at the return point specified in the rental contract before the end of the rental period during the Lessor's opening hours. The rental price for rental objects returned too late or incorrectly stored as well as the resulting consequential costs will be charged to the Lessee. The vehicle as well as all accessories provided by the Lessor, such as child seats, keys, bicycle helmets etc., must be returned to the Lessor complete and in perfect condition when returning the vehicle. Loss or damage will be charged to the Lessor.

5. Extension of the rental period
An extension of the lease is only possible with the consent of the Lessor before the end of the current lease. The Lessor may refuse the extension without giving reasons. The rental price will be recalculated, the surcharge must be paid at the latest when returning the bicycle.

6. Minimum age of the Lessee
Children and adolescents under 16 years of age must be accompanied by an adult. Children and adolescents under the age of 16 who are not accompanied by an adult may only be given rental bikes with the written consent of their parents or guardian.
The minimum age for riding an e-bike with a support up to max. 25 km/h is 16 years old by law (14 years old with a moped license).

7. Services, prices and payment methods
The prices of the price list valid at the time of rental and published in the Lessor's brochure shall apply, including the discount provisions contained therein. Misprints remain reserved. Discounts will only be granted upon presentation of the appropriate identification. Discounts are granted locally and cannot be cumulated.

The rental prices are to be paid in advance. You have the possibility to pay the amount by credit card, via PayPal, or advance invoice.

8. Cancellation/termination
A confirmed reservation can be cancelled or adjusted free of charge up to 24 hours before the start of the rental period. Bookings cancelled less than 24 hours before the start of the rental period will be charged 100% according to the applicable rates, as for bookings not consumed. In the event of termination of the rental period, there is no entitlement to reimbursement of the unused remaining rental period.
9. Liability and insurance
9.1 Liability insurance
The insurance is the responsibility of the Lessee. By concluding the rental contract, the Lessee confirms that he/she has a liability insurance and thus sufficient cover for the risks involved in riding a bicycle or e-bike. The liability also extends to damage costs such as expert costs, depreciation or renting termination costs.
9.2 Defects during the rental period
In case of defects during the rental period, the Lessee can exchange his/her bicycle at another B4U rental point for an equivalent vehicle.
If there is no rental office in the vicinity or no replacement bicycle is available, the Lessee may, with the consent of B4U, have the defect repaired at the nearest bicycle dealer. The repair costs can be claimed against receipt from the Lessor.
The Lessee is in any case responsible for the return transport of the bicycle to the nearest possible return point.
9.3 Damage, theft and loss
The Lessee is obliged to notify the Lessor of any damage or loss that has occurred.
The Lessee is liable for all damage caused to the rented object and its accessories during the rental period as a result of falls, vandalism, impact of elements, manipulation, impact from transport as well as its improper use.
The costs for minor damage and loss of material will be charged to the customer directly by the rental office according to the official B4U price list.
The Lessee is liable in case of theft or loss of the rental object or accessories during the rental period. The vehicle must always be secured. The loss will be charged to the Lessee at replacement value.
If the Lessee hands over the vehicle to a third party, he/she is generally liable for damages and consequential damages caused to the vehicle by third parties.
9.4 Accidents
Accidents and falls with material damage must always be immediately reported to B4U. If persons are injured and/or property damage is caused to third parties or if a third party is involved as a possible (co-)causer, the police must be called in immediately and an accident report must be filled in. A copy of this must be sent to B4U.

10. Use/prohibitions
The Lessee undertakes to comply with the Road Traffic Act and to use the bicycle properly and carefully.
The Lessee is responsible for all damage resulting from negligence or improper use of the rented property on the same or third-party objects. It is not permitted to misuse the vehicles, to transport one or more additional persons on the luggage rack or to drive over obstacles where the vehicle is obviously likely to suffer damage.
The use of the rental equipment for racing purposes is prohibited.
The use and wearing of the rental helmets are voluntary and at your own risk. The Lessor declines any liability in this matter.

11. Applicable law and place of jurisdiction
This contract is subject to Swiss law. Exclusive place of jurisdiction is Lucerne (LU).
